Bank Secrecy Act (BSA)

The Bank Secrecy Act (BSA), also known as the Currency and Foreign Transactions Reporting Act, is a U.S. law that has a significant impact on the gaming industry. Enacted in 1970, the BSA is designed to prevent money laundering, terrorist financing, and other financial crimes by requiring financial institutions and certain businesses, including casinos, to maintain records and report suspicious activities to the Financial Crimes Enforcement Network (FinCEN). For gaming establishments, compliance with the BSA is not just a legal requirement but a fundamental aspect of maintaining the integrity and trust of their operations.

In the gaming industry, the BSA mandates that casinos implement robust anti-money laundering (AML) programs. AML programs must include policies, procedures, and internal controls to detect and prevent suspicious transactions. For example, casinos are required to verify the identity of their customers, monitor large cash transactions, and report any activities that may indicate money laundering or other financial crimes. This involves maintaining detailed records of transactions, customer information, and any suspicious activities, which must be readily available for inspection by regulatory authorities.

The BSA also requires casinos to file specific reports, such as the Currency Transaction Report (CTR) for cash transactions exceeding $10,000 and the Suspicious Activity Report (SAR) for any transactions that appear to be suspicious or illegal. These reports help law enforcement and regulatory agencies track and investigate financial crimes.

Compliance with the Bank Secrecy Act is not just about avoiding penalties; it is also about protecting the reputation and financial health of the gaming establishment. This naturally includes a need to implement strong identity and access management solutions to prevent unauthorized access and cyberattacks. Controlling who can access sensitive data and systems is another key aspect of compliance.
